The study concludes that although the opening of usucaption by the administrative form was created to privilege the social function, since the procedure would be more agile and thus, the one that effectively gives a social destination to the property would own it, the many requirements in law so that the transfer of ownership can be effected to the present owner practically unviable the litigation procedure, being only applicable when it comes to voluntary jurisdiction.

O estudo conclui que, apesar da abertura da usucapião pela forma administrativa ter sido criada para privilegiar a função social, já que o procedimento seria mais ágil e assim, o quanto antes a propriedade seria daquele que efetivamente dá uma destinação social ao imóvel. os muitos requisitos exigidos em lei para que possa ser efetivada a transferência da propriedade ao atual possuidor praticamente inviabilizam o procedimento contencioso, sendo cabível apenas quando se trata de jurisdição voluntária.
