princípio da reserva do possível, inerente e específico ao Direito Administrativo é alvo de questionamentos doutrinários quanto à sua eficácia e diante à impressão de disponibilidade prática das garantias e direitos fundamentais previstos na constituição Federal de 19,8, principalmente no que tange a discricionariedade da administração pública; desta forma, reduzido a exemplo do que concerne à aplicação da reserva do possível para com o direito subjetivo de garantia ao acesso à saúde do particular hipossuficiente, busca-se compreender, pelos princípios constitucionais e público-administrativos, quando o Judiciário deverá intervir no Estado para garantir a razoável relação entre a administração pública e o particular, pois, torna-se concernente a interpretação ampla do Direito Administrativo e do Direito Constitucional.
