It follows that the annualised hours has several aspects that can harm the workers’ health, such as: a) the passing, intrinsic of the system, of the daily limit of eight working hours, and extrapolation, irregularly, of the border of ten daily working hours, established as ceiling within this regime, entering the employee, in both cases, the period in which there is greater risk of occupational accidents; b) irregular distribution of working hours throughout the year, affecting the employees’ biological clock and leading others health problems; c) definition of days off made, usually, by the employer; d) not granting of days off.
Conclui-se que a compensação anual de jornada possui vários aspectos que podem prejudicar a saúde do trabalhador, tais como: a) ultrapassagem, intrínseca ao sistema, do limite diário de oito horas de trabalho, e extrapolação, de forma irregular, da fronteira de dez horas diárias de trabalho, estabelecida como baliza máxima dentro desse regime, adentrando o trabalhador, em ambos os casos, no período em que há maior risco de acidente do trabalho; b) distribuição irregular da jornada ao longo do ano, afetando o relógio biológico do empregado e acarretando outros problemas de saúde; c) definição dos dias das folgas ser feita, geralmente, pelo empregador; d) não concessão das folgas.
