Although they have been incorporated into brazilian legal system, having supra-legal status, many of its provisions are not complied with, such as the right of the arrested person to be presented promptly before a judge, for him to decide about the legality of his arrest, the respect of his fundamental rights and his freedom.

Estudo eminentemente teórico, sustentado na análise de dados já colhidos, como o Mapa de Implantação de Audiência de Custódia do CNJ, e que tem por objetivo analisar se as audiências de custódia ocorridas no Brasil têm trazido redução nas prisões preventivas, bem como analisar se é um instrumento que efetiva a redução de tortura e/ou maus-tratos da pessoa presa.
For that, we made a research concerning the historical and conceptualization of citizenship in Brazil, the initial and basic concepts on the punishment by confinement and the proper treatment of the prisoners in the past and the present, going through the main constitutional principles of the imprisoned person.
